Overview
These SMS Messaging Terms and Conditions ("Terms") govern your participation in the SMS messaging program (the "Program") operated by Ram Performance, LLC, located at 9161 Comar Dr Suite F, Walker, LA 70785, US. By opting in to receive SMS messages from Ram Performance, LLC, you agree to these Terms. If you do not agree, do not opt in, or text STOP to cancel at any time.
1. Program Description
By providing your mobile phone number and opting in, you consent to receive SMS and MMS messages from Ram Performance, LLC related to customer care and your service with us. These messages may include, but are not limited to:
• Appointment reminders and service updates
• Work order updates and status notifications
• Estimates, quotes, and invoice notifications
• Payment confirmations and payment links
• Service completion notifications
• Customer care and satisfaction follow-ups
Ram Performance, LLC does not send promotional or marketing text messages through this Program.
2. Consent and Opt-In
By providing your phone number to Ram Performance, LLC and agreeing to receive text messages, you expressly consent to receive recurring SMS and MMS messages from Ram Performance, LLC. Consent is not a condition of purchase or service. You may provide consent by any of the following methods:
• Entering your mobile number and checking the SMS consent box on our online SMS opt-in form (the checkbox is unchecked by default and not required to make a purchase)
• Verbally providing your phone number and agreeing to receive texts in person or over the phone
• Submitting your phone number through the Ram Performance, LLC website, intake forms, or point-of-sale system
• Responding to an invitation to opt in via text message
3. Message Frequency
Message frequency varies based on your interactions with Ram Performance, LLC and the services you request. You may receive recurring messages depending on appointment schedules and service activity. This is a low-volume program tied to your active service relationship with us.
4. Message and Data Rates
Standard message and data rates may apply depending on your mobile carrier and plan. Ram Performance, LLC is not responsible for any fees charged by your mobile carrier for sending or receiving SMS or MMS messages.
5. Opt-Out / How to Stop
You may opt out of receiving SMS messages from Ram Performance, LLC at any time by texting STOP to the number from which you received a message. After opting out, you will receive a one-time confirmation message and will no longer receive SMS messages from Ram Performance, LLC unless you re-subscribe.
Opting out of SMS messages will not affect any other communications you may receive from Ram Performance, LLC via email or other channels, and will not affect the services we provide to you.

7. Privacy and Data Protection

Ram Performance, LLC will not sell, rent, or share your mobile phone number or any personal information collected through the SMS Program with third parties or affiliates for their marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.
Information collected through the Program may be shared with service providers who assist Ram Performance, LLC in delivering messages (e.g., SMS platform providers), but only to the extent necessary to operate the Program and deliver messages on our behalf. Such providers are contractually prohibited from using this information for any other purpose.
8. Supported Carriers
The Program is supported on major U.S. mobile carriers, including but not limited to AT&T, T-Mobile, Verizon, and U.S. Cellular. Carriers are not liable for delayed or undelivered messages. Service availability may vary by carrier and is not guaranteed.
9. Disclaimer of Warranties
The Ram Performance, LLC SMS Program is provided on an "as is" and "as available" basis. Ram Performance, LLC makes no warranties, express or implied, regarding the availability, reliability, or timeliness of messages. Ram Performance, LLC is not responsible for any delays or failures in the delivery of SMS messages due to carrier issues, device incompatibility, network outages, or other circumstances beyond our control.
10. Changes to These Terms
Ram Performance, LLC reserves the right to modify these Terms at any time. Any changes will be effective when posted. Your continued participation in the Program after changes are posted constitutes your acceptance of the updated Terms.
